This website is operated by Sunny Transfers. Throughout the site, the terms “we”, “us” and “our” refer to Sunny Transfers. Sunny Transfers offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Sunny Transfers operates as an agent for third party transport providers (referred here as the "Supplier"). When purchasing a transportation service you enter in a contract between you and the Supplier.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

SECTION 1 - ONLINE SERVICE TERMS

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Sunny Transfers is an online company and therefore all communication unless otherwise agreed will be via email

SECTION 3 - ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

In the event of a price change we will inform you for the correct price. If the new price quoted is higher than the price initially stated you may cancel the order and receive a refund of the full amount you have paid.

SECTION 5 - PRODUCTS AND SERVICES

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product or service at any time. Any offer for any product or service made on this site is void where prohibited.

Sunny Transfers operates as an agent for third party transport providers (suppliers). When purchasing a transportation service you enter in a contract between you and the Supplier. We accept no liability for the failure of the supplier to perform the booking or for any other incident in connection with the booking.

When purchasing a product or service from Sunny Transfers you are contracting directly with the Supplier, and thus you are also bound by their terms and conditions applicable to your purchase.

If you disagree with any of these terms and conditions you may not place an order via our Service.

Sunny Transfers do not guarantee the successful allocation of a booking request to a Supplier. In these cases you will be advised by an email. Any alternatives offered may include additional charges.

When a booking request is successfully allocated to a Supplier we will issue you with a voucher on behalf of this Supplier with a unique voucher number.

It is your responsibility to check the details of your booking on the voucher prior to travel. If there are any errors in the details you must inform us immediately.

You must present your voucher to the Supplier or its representative (driver) before your arrival and your departure transfer. The Supplier can refuse the transfer if your voucher can not be produced.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Any special requests will be passed to the Supplier. Sunny Transfers can not guarantee that they will be met and we accept no liability if they are not.

SECTION 6 - ADDITIONAL SERVICES

Sunny Transfers will always try to provide you with a child seat if one is requested. Unfortunately we can not guarantee that a child seat will always be provided due to possible availability issues. The EU directive 2003/20/EC exempt licensed taxis from the requirement that children must use an appropriate child seat until they reach 12 years of age or until they reach a height of 135 cm. If no child seat is available, children of three years of age and over may travel as long as they wear an adult seat belt, and children under three years of age may be transported without a safety restraint as long as they travel in the rear of the vehicle.

Sunny Transfers is not a specialist disabled transfer company but will try to assist with any special requirements you might have due to a medical problem or disability which may affect your transfer. You will need to provide us with full details in order to make the appropriate arrangements.

If any of the passengers use a wheelchair you need to inform us before the booking is made. You should indicate whether the wheelchair is collapsible or not in order for us to allocate the correct vehicle type. Failure to properly inform us on time might lead to additional charges.

If a custom excursion is booked you will be supplied with an approximate route that the booked vehicle will follow and the duration (number of hours) of your excursion. The driver may have to follow an alternative route or even visit alternative sites due to local conditions and circumstances.

If you change the route or the duration of your excursion additional charges may arise that you will have to pay locally.

Transfers are booked from the pickup point to the final drop off point only. In case extra stops are required (e.g. to collect a key of an apartment, forgotten items, etc.) a local extra charge payable directly to the supplier may apply. The agreement and payment of those extra charges are between you and the supplier.

SECTION 7 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You are solely responsible for the accuracy of all details you provide to us for the purpose of purchasing the Service from the Supplier. Sunny Transfers can not be held responsible for any problems that might arise due to inaccurate information given during the booking process which may lead to the supplier being unable to successfully provide the service requested.

The credit or debit card used for your purchase must be your own, and sufficient funds or credit facilities must be available for the purchase of the products or services. We reserve the right to obtain validation of your credit or debit card details. If the validation cannot be obtained or the payment is not made, we reserve the right to cancel the whole transaction.

It is your responsibility to check if your booking has been successful. A voucher will automatically be issued via email after a successful booking and payment for a service. If you do not receive an email, it is your responsibility to check if a booking has been successful including calling your bank to check is payment has been processed prior to proceed with booking again in order to avoid duplication. We will not accept any liability for charges applied by the Supplier in the case of duplication.

The price for each Service is the price displayed on our website at the date and time of your booking. By accepting these terms and conditions you waive your right to have the Service fare calculated on a taximeter.

Prices quoted are per vehicle unless otherwise explicitly indicated.

SECTION 8 - BOOKING CHANGES AND CANCELLATIONS

Changes for a booking made can only be made up to two (2) days prior to the first transfer of the booking. You will need to contact us by e-mail at info@sunnytransfers.com or using the contact form in our website at https://sunnytransfers.com/contact.php. You will need to supply us with your booking reference number and any other relevant information, as well as the requested changes. Any correspondence should be made during normal Greek office hours and any correspondence made outside these hours will be considered as made the following day.

Any change made to the destination hotel will incur no charges as long as the hotel is in the same resort area.

Sunny Transfers will try to assist with any changes made to a reservation, but can not guarantee that any request will be met.

A 10€ administration charge will be levied to any change made less than two full days from the first transfer of the booking. Additional charges may apply if the change requested changes the price of the service requested in your original booking.

Cancellations can only be made four (4) days prior to the first transfer of the booking. Any cancellation made before that will be refunded in full.

Any cancellations made less than four (4) days prior to the first transfer of the booking will incur a 50% cancellation fee. Any cancellations made less than two (2) days prior to the first transfer of the booking will incur a 100% cancellation fee. If the customer fails to show up a 100% cancellation fee will also incur.

Should you cancel the return portion of your transfer service whilst in resort you will not be entitled to any refund of the unused portion of the service.

Sometimes cancellation fees can be covered by holiday insurance. Please check your insurance policy before your purchase.

If for any reason Sunny Transfers is unable to provide the service you booked, we reserve the right to provide you with alternative service of the same or higher standard. In the unlikely event that an alternative can not be provided a full refund will be issued.

SECTION 9 - FLIGHT DELAYS OR CANCELLATIONS

If your flight or connecting flight is delayed, cancelled or diverted, you will need to call the supplier and inform him in order for your pickup to be rescheduled. The supplier details and telephone number are shown on your booking voucher.

Failure to inform the supplier of cancelled, diverted or rescheduled flights may result in your transfer being provided as originally requested and you not showing up. The supplier cannot be held responsible in this instance and no refund will be given.

Sunny Transfers will try to assist with any problems arising from flight cancellations, delays and flight diverted, but can not guarantee that any request will be met. If you fail to notify your supplier on time to prevent the taxi from travelling to the airport or pickup point you may have to book another taxi and pay additional charges locally.

If your flight gets diverted to another airport, additional charges might apply which you have to pay locally.

SECTION 10 - BAGGAGE

Each passenger the transfer is booked for is entitled to carry with him on the relevant transfers one suitcase which should not exceed 70cm x 40cm x 20cm and one piece of hand luggage.

If your baggage exceeds the allowed number or size, or include bulky items (e.g. skis, golf clubs, bicycles, wheelchairs/scooters etc.) you should notify us at the time of the booking.

Our suppliers will always try to accommodate any additional or bulky baggage but additional charges may apply.

Baggage is carried entirely at your own risk and Sunny Transfers can accept no responsibility for loss or damages. We will also not accept any responsibility for any costs incurred in returning the items to passengers that have not collected them during the arrival to your destination.

SECTION 11 - CONDITIONS OF CARRIAGE

Sunny Transfers and its suppliers reserve the right to refuse to carry any passenger who is, or appears to be under the influence of alcohol or illegal drugs and/or whose behavior is considered to pose a threat to the driver, the vehicle or the other passengers. No refunds will be made in those circumstances.

The consumption of alcohol by the passengers during the transfer is not allowed. Smoking is also not permitted during the transfer.

Sunny Transfers can not guarantee that the vehicle will arrive on time for the pickup nor that it will reach its destination on time and thus accept no liability in the event of a delay. It is your responsibility to ensure that you get to the airport on time for your flight check-in and Sunny Transfers will not be held liable for any costs if you miss your flight.

If your taxi does not arrive on time you should call the transfer provider (supplier) and ensure that you seek an alternative method to get to the airport in order to mitigate your losses. Please ensure that you obtain a receipt when paying for alternative transport to the airport and then submit this to Sunny Transfers together with your booking reference number and the description of the incident for investigation with the supplier. If the transfer provider is found to be in error you will be refunded the cost of the taxi. Unfortunately we cannot refund any costs without provision of a receipt.

Due to local conditions sometimes the door to door pick up and drops off may be prevented in case of road-works, traffic conditions, etc. Where these restrictions occur, the vehicle will stop and collect passengers from the nearest accessible point.

We strongly advise all our customers to purchase a travel insurance to cover them from a comprehensive range of unfortunate events such as accidents, health issues, cancellation, baggage loss, etc. whilst they are traveling.

SECTION 12 - OUR RESPONSIBILITY

Sunny Transfers will always select suppliers of transfer services using reasonable skill and care. We accept no liability for the actual provision of the transfer services unless it is proved that we have selected the supplier without reasonable care and you have incurred loss or damage as a result.

Sunny Transfers operates as an agent for third party transport providers (suppliers). We will forward your reservations to the appropriate supplier and will inform you with any changes to the status of your reservation. When purchasing a transportation service you enter in a contract between you and the Supplier. We accept no liability for the failure of the supplier to perform the booking or for any other incident in connection with the booking.

Any claim for loss, injury, illness or death should be pursued with the supplier or covered under the terms of your holiday insurance. We only accept liability to you for claims which arise solely as a result of our own negligence.

Our liability to each passenger, except in cases involving death or personal injury, shall be limited to a maximum of twice the cost of each passenger's booking for the transfer.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or address. In the event that we make a change to or cancel a booking, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

SECTION 13 - FORCE MAJEURE

Force majeure means that neither we nor the supplier will pay you compensation if a cancellation or change is made to any service because of unforeseeable circumstances beyond our or the supplier's control. These can include, but are not limited to, accidents and related delays, industrial actions, demonstrations, civil unrest, police operations, unforeseen road hazards, terrorist activity, the act of any government or local authority, natural or nuclear disaster, fire, explosions, severe weather conditions or other similar events outside our or the supplier's control.

SECTION 14 - OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

SECTION 15 - THIRD-PARTY LINKS

Certain content, products and services available via our Service may include materials and / or services from third-parties.

Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

SECTION 16 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

SECTION 18 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product or services descriptions, pricing, promotions, offers, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

SECTION 19 - PROHIBITED USES

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Sunny Transfers, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Under no circumstance will Sunny Transfers be held responsible for any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, delays, or any similar damages from the service provided to you by our suppliers.

SECTION 21 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Sunny Transfers and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 22 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 23 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 24 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 25 - GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of Greece. You and Sunny Transfers agree to submit to the exclusive jurisdiction of the courts of the Heraklion, Crete, Greece.
